All federally funded highway construction contracts are subject to the federal Davis-Bacon and Related Acts. The U.S. Department of Labor has empowered the North Dakota Department of Transportation to enforce all pertinent labor laws pertaining to Davis-Bacon wage rates, overtime, fringe benefits, payrolls, etc. Any contractor employee who feels he or she has not been properly paid may file a wage rate complaint with the department.
