The Uniting & Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT) Act was signed into law on October 25, 2001.

This Federal law addresses terrorism and national security and includes provisions that require commercial drivers who transport hazardous materials to have their fingerprints taken and successfully complete a Federal criminal history background check (federal security threat assessment).

New (Initial) Hazardous (H) material endorsement holders

  1. Driver must first obtain a North Dakota commercial permit or a North Dakota commercial license.
  2. Initiate the federal security threat assessment.
  3. A federal security threat assessment must be completed and ND commercial license must be obtained prior to step 4.
  4. All initial hazardous (H) endorsement holders must complete the required federal theory entry level driver training Training Provider Registry (dot.gov).
  5. Take the Hazardous material knowledge test in order to put the H endorsement on their North Dakota CDL license.

Renewal applicants and Transfer applicants

Renewal applicants and Transfer applicants
  1. Applicants with a North Dakota Commercial Driver's License who are renewing their H endorsement
    will be required to undergo the federal security threat assessment.
  2. Applicants with Out-of-state Commercial Driver's License will need to obtain a North Dakota Commercial Driver's License
    in order to initiate the federal security threat assessment
    however, if the prior state of record can confirm that a security assessment was already done,
    North Dakota may honor that assessment pending the time remaining on it.
  3. When the security assessment is passed, the driver can then take the Hazardous material knowledge test
    in order to put the H endorsement on their North Dakota Commercial Driver's License.
